Terms of Service for MyKaraoke Video

These Terms of Service ("Terms") govern your access to and use of MyKaraoke Video, a software-as-a-service platform provided by Qwixor LLC ("Company", "we", "our", or "us"). By accessing or using MyKaraoke Video, you agree to be bound by these Terms. If you do not agree to these Terms, do not use MyKaraoke Video.

1. Service Description
   MyKaraoke Video (Service) is a web-based application that allows users to create karaoke and lyric videos utilizing AI-driven lyrics synchronization and music separation tools. The Service functions exclusively as a technical tool and platform for users to manage their own content. We do not endorse, pre-screen, or assume responsibility for any content generated by users.

2. User Restrictions
   The Service is designed for users aged 13 and above. You bear full and exclusive responsibility for ensuring that your use of the Service, as well as any content you create, upload, or process through it, adheres to all relevant local, provincial, federal, and international laws, regulations, and rules. This includes, but is not limited to, those related to copyright, intellectual property, privacy, and data protection.

3. Account Registration
   To use the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary.

4. Subscription and Payments
   MyKaraoke Video is available through pay-per-use or subscription plans. All payments are processed by secure third-party providers, including Stripe. You agree to pay all fees and applicable taxes in accordance with your selected plan. All payment information is managed by the third-party provider and is not retained by us.

5. Free Access
   While the Service does not offer a traditional free trial, users may access the Service without a subscription plan at no cost, and no credit card is required for this access.

6. User-Generated Content
   All content generated by users on the platform remains the property of the user. Users bear full responsibility for the use and distribution of their content. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, modify, and distribute your content on the Service solely for the purposes of operating, developing, and improving the Service.

7. Copyright and Licensing
   The Service does not provide commercial licenses for the content generated. Users are responsible for securing the necessary licenses if they wish to use or distribute the content for commercial purposes.

8. Refunds Policy
   Refunds are issued solely for confirmed technical failures of the Service (for instance, a total inability to export a video following payment, or a system error that obstructs the delivery of core functionality). Refunds are not provided for subjective dissatisfaction with the output, user error, or in cases where a credit has been successfully utilized to initiate a process, even if the resulting output does not meet expectations due to the inherent nature of AI or user input.

9. Payment and Taxes
   Payments and applicable taxes are processed through Stripe, Inc. By providing payment information, you agree to pay all charges incurred through your account at the prices in effect when such charges are incurred. You are responsible for any taxes applicable to your transactions.

10. AI-Generated Content Disclaimer
    Our AI tools are intended to facilitate lyrics synchronization and music separation. Although we aim for precision, the outcomes produced by our AI may be inconsistent, imperfect, or contain errors. We do not guarantee flawless synchronization, accurate lyric transcription, complete music separation, or any particular quality of output. You acknowledge that AI-generated content has inherent limitations and should be reviewed and verified by you.

11. Service Availability
    We do not assure uninterrupted, error-free, or secure access to the Service. The Service may be temporarily unavailable due to maintenance, technical issues, or other factors beyond our control. The Service is offered on an "AS IS" and "AS AVAILABLE" basis.

12. Limitation of Liability
    To the maximum extent permitted by law, Qwixor LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

13. Disclaimer of Warranties
    The Service is provided on an "as is" and "as available" basis. Your use of the Service is at your own risk. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Service, or the information, content, materials, or products included on the Service.

14. Governing Law
    These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

15. Changes to Terms
    We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms. By continuing to use the Service after the changes become effective, you agree to be bound by the revised Terms.
